Comilmart Trademark Statement & Intellectual Property Rights Notice

1. Introduction
This Trademark and Intellectual Property Rights Notice (“Notice”) outlines the ownership, use, protection, and permitted usage of the trademarks, brand names, logos, slogans, domain names, and other intellectual property owned by Comilmart and our parents company Macver Technology, a multivendor e-commerce platform dedicated to empowering African businesses and consumers across local and global markets. This statement governs your interaction with Comilmart’s brand and intellectual property, including use of our platform, products, services, and content.
By accessing our website, mobile app, API, or engaging in any commercial or non-commercial activities involving Comilmart’s brand assets, you agree to abide by this Notice in addition to our Terms and Conditions, Privacy Policy, and any other applicable policies.
2. Ownership of Trademarks and Intellectual Property
All rights to the name “Comilmart”, its associated logo, domain name, design marks, brand elements, trade dress, and slogans (including but not limited to: “Think Comilmart,” “Africa’s Trusted Marketplace,” “Where Africa Shops,” and “Shop. Sell. Grow.”) are the exclusive intellectual property of Comilmart or its affiliated entities.
These trademarks are registered or in the process of being registered under the laws of Nigeria, the African Regional Intellectual Property Organization (ARIPO), the African Intellectual Property Organization (OAPI), and other jurisdictions globally, including but not limited to the United States, United Kingdom, Canada, and the European Union.
Comilmart retains full legal rights and title to all registered and unregistered trademarks, service marks, logos, trade names, and any other brand features displayed on the platform or in connection with its business operations.
3. Protection of Brand Identity
The Comilmart trademark portfolio includes, but is not limited to:
- Wordmarks: Comilmart™, Shop with Comilmart™, Think Comilmart™, Sell Globally™, Africa’s Trusted Marketplace™, Your Online Market™, and other slogans used in marketing and communication.
- Logos: The Comilmart logo and its stylized versions including variations for vendors, logistics, payments, and other sub-brands.
- Trade Dress: The color schemes, layout design, graphics, fonts, and visual presentation of the Comilmart website, mobile app, and advertising materials.
These assets are protected under national and international trademark and copyright laws, including but not limited to the Trade Marks Act (Nigeria), the Paris Convention, the TRIPS Agreement, and WIPO treaties.
4. Prohibited Use of Comilmart Trademarks
Except as expressly permitted in a written agreement with Comilmart, unauthorized use of our trademarks is strictly prohibited and may constitute infringement or misappropriation of intellectual property.
Prohibited uses include but are not limited to:
- Using the “Comilmart” name or logo in connection with your own business, service, app, or domain without written consent.
- Creating any false association, endorsement, or partnership with Comilmart.
- Using Comilmart’s name in a misleading way in meta tags, search engine ads, or social media profiles.
- Copying, modifying, or imitating Comilmart’s logo or trade dress in any form.
- Registering domain names, social media handles, or business names that are confusingly similar to Comilmart or any of its trademarks.
Violators may be subject to legal action, including injunctions, damages, and penalties under applicable trademark laws.
5. Authorized and Permissible Use
You may only use Comilmart’s trademarks or brand assets under the following circumstances:
- Official partnerships: If you are a registered vendor, affiliate, logistics partner, or ambassador with a signed agreement that explicitly grants you limited rights to use Comilmart branding.
- Media and press: Media organizations may use the Comilmart name and logo for news coverage, press releases, and articles with appropriate credit and context. All such uses must maintain the integrity of the brand.
- Marketing materials: Comilmart may provide promotional materials to vendors or partners (banners, badges, digital assets) which may be used as instructed.
- Linking: You may link to Comilmart.com or reference our services, provided it does not mislead consumers or imply affiliation or endorsement.

6. Intellectual Property of Others on Comilmart
Comilmart values and respects the intellectual property rights of third parties. As a multivendor platform, vendors are responsible for ensuring they do not upload or sell counterfeit, stolen, or trademark-infringing goods.
Any listing, product image, or promotional content uploaded by vendors must not:
- Use copyrighted images, logos, or product names belonging to other brands without permission.
- Sell fake or knock-off products that infringe on well-known brands.
- Use misleading keywords or product descriptions that exploit other companies’ trademarks.
Comilmart has a zero-tolerance policy for IP violations, and repeated offenses may result in suspension or permanent removal from the platform.
If you believe your IP rights are being infringed by a vendor, please visit our Report Abuse page or email abuse@comilmart.com with details and proof of ownership.
7. Reporting Trademark Infringement
If you are a rights holder or legal representative of a brand and believe your intellectual property is being misused on Comilmart, you may report the matter through our official reporting procedure.
Submit a report with:
- Full name and contact information
- Proof of ownership (e.g., trademark certificate)
- Clear identification of infringing material (URLs, product titles)
- Description of the violation
Comilmart’s legal team will review the claim within 3–7 business days and take appropriate action, which may include content takedown, vendor warning, or permanent account suspension.
8. Trademark License Requests
Comilmart does not grant general license to the public for commercial use of its trademarks. However, exceptions may be made for:
- Approved partners and service providers
- Journalists, publishers, and research organizations
- Educational content creators and nonprofits

No rights are granted by implication, estoppel, or otherwise unless expressly stated in writing.
9. Digital & Social Media Guidelines
Comilmart’s trademarks and branding should not be used as:
- Part of your social media handle (e.g., @ComilmartFashionDeals)
- Part of your bio in a misleading context (e.g., “Comilmart Certified Seller” without approval)
- Backgrounds, banners, or profile pictures not provided by Comilmart
If you are an official vendor or brand ambassador, you will receive verified badges and promotional assets for authorized use on social platforms.
Violation of these rules may result in account suspension, platform removal, or legal proceedings.
10. Intellectual Property Disclaimers
- Comilmart is not affiliated with or endorsed by any third-party brand unless explicitly stated.
- Product listings that reference other brands are submitted by independent vendors.
- Comilmart does not guarantee the authenticity of products unless sold under the Comilmart Verified badge.
- Product names, logos, and brands appearing in listings may be trademarks of their respective owners.
11. Enforcement and Legal Remedies
Comilmart actively monitors its trademarks and brand assets online and offline. We use internal and third-party tools to identify unauthorized use, impersonation, or misleading branding.
We reserve the right to pursue legal remedies under applicable law, including but not limited to:
- Cease and desist letters
- Domain name recovery via ICANN or court
- Legal claims for damages
- Civil or criminal complaints under IP law
Violators may be held liable under the Nigeria Trade Marks Act, Cybercrime Act, and other international statutes, depending on the severity of infringement.
12. Governing Law and Jurisdiction
This Trademark Statement shall be governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
Any disputes relating to the misuse, infringement, or violation of Comilmart’s trademarks or intellectual property shall be subject to the exclusive jurisdiction of the courts in Lagos, Nigeria.
13. Updates to This Notice
Comilmart reserves the right to amend or update this Trademark & IP Notice at any time without prior notice. Updates will be posted on this page with an updated effective date. Continued use of the Comilmart platform implies acceptance of any changes.
